1. 1. Event participation

Taking part in a cookery event is at the participants own risk.

Each participant is personally liable for damages to clothing, other personal belongings and physical injuries unless the Kochkultour cooking school has acted willfully incorrectly or very negligently.

If one participant books on behalf of others (e.g. a complete booking for companies, birthday parties, etc.) he is then responsible for all of his guests. The participant will be made liable if he wantonly damages the property of the cooking school.

No responsibility is taken for wrong interpretations of our recipes and the results.

1.2. Hygiene Regulations

Every participant must obey the following rules of hygiene:

Hands must be washed at the beginning of the course and after every visit to the toilets.

No jewelry to be worn on hands.

Instructions from the course leader, regarding the hygienic treatment of food must be followed.

Persons with open, weeping and/or infected wounds on their hands or lower arms may not participate in the course. The same rule applies to people with fever, a cough and / or cold or diarrhoea.

1.3. Private Event Booking

The number of participants per event is limited. Applications are taken in the order of their arrival.

The course must be paid for within 14 days of receipt of booking confirmation. Late bookings within 14 days before of the event, must be paid for immediately. Payment can be made in cash, via bank transfer or debit.

If payment is not completed within the timescale detailed, the event will be considered as not booked and the place/s will be made available for other participants.

If a participant is unable to attend an event, it is permissible to send a replacement/substitute person instead.

If a participant withdraws from a booked event , the following charges will be applied:

Cancellation of the event within 8 days of the event: 100% of the event fees.

Cancellation of the event more than 8 days before the event: the participant will be given a voucher for the complete amount that has already been paid.

A refund in cash or via bank transfer is not possible.

If a participant fails to attend for a booked event, there will be no refund, or in the case of no advance payment, the whole fee is payable.

Vouchers are not exchangeable for cash.

1.4. Event Booking/ cancellation

When a private event is booked, the number of participants booked (at least 5 days before the event), is considered as binding. In the case of a short notice withdrawal of individual participants a partial refund is not possible.

Cancellation charges/refunds

If the event is cancelled more than 7 workdays in advance the cancellation charge is 150€. Cancelling the whole event within 7 to 4 workdays in advance, 50% of the agreed sum will have to be paid as a cancellation charge, when cancelling within three workdays or less before the event, the sum will be 100%.

1.5. New Item

Kochkultour reserves the right to cancel courses due to too few participants, unavailability of the chef (e.g. sickness) or other special circumstances. The participants will receive a voucher for the amount already paid. This voucher can be used on another occasion. A refund in cash or via bank transfer is possible, if required.

The participant will usually be informed about the cancellation at least 3 days before the event. Requests by course participants to cancel events is not possible.

1.6. Data Protection

Participants are not obliged to fill in any forms including personal data (e-mail address, name, address) on our website. Kochkultour states clearly, that this data will not be passed on to third parties.

1.7. Legal Effectiveness

Should a section/sections of these terms and conditions not conform (fully or partly) with current legal status, other sections retain their validity and remain untouched.

1.8. Publications

All articles and contributions on this website become invalid with the publication of a newer edition. Changes to prices and contents of the courses are permissible. All the recipes underlie copyright law. Printing and distribution are only allowed with the permission of Kai Mehler.

2.1. General

Quoted prices for end users are inclusive of value added tax. All prices in our Web-Shop are subject to alteration.

The following conditions apply to non-trade customers:

2.2. Right of Return

You have the right to return goods without reason within 14 days. This applies, however, only to „Hardware", i.e. not to food and not to goods that have been exclusively ordered to your wishes, and do not belong to the Kochkultour standard range. Should you make use of this right, we request that you follow the rules as described in the following terms and conditions.

2.3. Prices

All prices are quoted in EURO (€). We reserve the right to change prices, and prices quoted in error are not binding. In catalogues, product lists and special offers the prices are not binding, unless they are individually agreed clearly and in writing.

2.4. Payment

Payment in Advance
Upon receipt of the invoice, please pay the invoice value by bank transfer. Please include the invoice number and customer number within the bank transfer details. Once your payment has arrived in our account, we will despatch your goods immediately. You will receive our the bank details with the invoice.
Cash Payment
Payment upon receipt must be made in cash. Please note that collection of goods can only be made after agreeing a collection time.

Orders can be placed via telephone, fax or email. They are binding. A written confirmation will only be sent if specifically requested by the customer. The buyer is responsible for the legality and correctness of the order. This will not usually be checked by us. Special orders for goods that are not part of our range are generally excluded from the right of return. The procurement and processing of special orders will only take place after receipt of written confirmation from the customer.

2.5. Unavailability of Goods

Should Kochkultour discover, after acceptance of an order, that the ordered goods or services are no longer available, or cannot be delivered due to legal reasons, then Kochkultour may offer an alternative product of similar price and quality, or cancel the order. After cancellation of an order by Kochkultour or by the customer, any monies already received will be immediately returned to the customer.

2.6. Shipping Costs

After receipt of payment in our account, we deliver within a few days free of delivery charge inside Germany for orders of over €150 (€6.50 deliver charge for orders under €150). Deliveries outside Germany will be subject to the relevant actual costs incurred. A list of the current applicable charges is included in delivery cost table below.
The relevant import and customs requirements must be observed and followed by the buyer. Cookery course vouchers are sent free of delivery charge.

2.7. Delivery

Delivery generally follows directly after receipt of payment. Self collection is available by arrangement. Claims cannot be made for late delivery. Deliveries are carried out by a transport partner of our choice or via our own couriers. The buyer is responsible for additional costs of EXPRESS or SATURDAY delivery, as well as any other non-standard delivery methods.

2.8. Checking of Goods Received

Before signing the delivery note and accepting the goods, goods must be checked by the buyer for breakage, damage and completeness, in presence of the courier.
Due to insurance arrangements, complaints made later cannot be considered. Goods generally leave our stores in faultless condition. With your signature you confirm receipt of a complete and undamaged delivery . Complaints made later will be rejected by the courier, using the evidence of the undisputed delivery acceptance.

2.9. Complaints

Kochkultour must be informed immediately should a reason for complaint arise. If the fault is discovered during the goods received check, then the details must be recorded on the courier’s delivery documents. Faults are to be reported promptly, up to a maximum of 3 days after receipt of the goods, according to § 377 HGB (German Commercial Code). Complaints received later cannot be considered. Fresh goods and open foodstuffs cannot be returned.
In case of a justified complaint, we will in certain circumstances arrange for collection of the goods. Damage that amounts to more than the value of the goods must be reported immediately. The damaged item must be preserved and in certain cases made available to us for inspection (perpetuation of evidence).
Please do not send goods back without prior arrangement, as we must refuse to accept such returns.

2.10. Exchange of Goods

You have the right to return goods without reason within 14 days. This applies, however, only to „Hardware in original packaging", i.e. not to food and not to goods that have been exclusively ordered to your wishes, and do not belong to the Kochkultour standard range. The return must be agreed with us in advance, and the cost of return must be borne by the buyer. Upon receipt of the goods we will send you a voucher to the value of the returned goods. Please do not send goods back without prior arrangement, as we must refuse to accept such returns. Changes to cookery course bookings can be made without charge up until 7 days before the beginning of the course

2.11. Retention of Title

All goods remain the property of Kochkultour until payment is made in full.

2.12. Final Clause

Should all or part of these conditions become ineffective as a result of a change in obligation law (guarantees) or any other legal regulations, then the relevant law within HGB (German Commercial Code) / BGB (German Civil Code) that is most similar to the actual meaning and commercial purpose of the ineffective passage will come into effect. The same applies in the case of a gap in these conditions.
